EXEMPTION FROM PARAGRAPH 571.08(1)(b) OF THE CANADIAN AVIATION REGULATIONS

Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to adversely affect aviation safety, I hereby exempt persons who perform maintenance on General Electric (GE) turbofan engine models CF34-8C, CF34-8E and CF34-10E installed or intended to be installed on Canadian aircraft (“maintenance persons” hereinafter) from compliance with the requirements set out in paragraph 571.08(1)(b) of the Canadian Aviation Regulations (CARs),

  • only with respect to the installation of GE CF34-8C/E and CF34-10E engine fan blades that have undergone maintenance performed and certified by IHI Corporation (IHI), of 229 Tonogaya, Mizuho-Machi, Nishitama-Gun, Tokyo 190-1297, Japan; and

  • only until such time as an agreement or technical arrangement between Canada and Japan is in place that provides for the reciprocal recognition of each party’s maintenance certifications,

subject to the conditions specified herein.

The purpose of this exemption is to authorize persons who perform maintenance on GE turbofan engine models CF34-8C, CF34-8E and CF34-10E, installed or intended to be installed on Canadian aircraft, to install specified part number fan blades that have undergone maintenance and which are accompanied by a maintenance release contained in an Authorized Release Certificate issued by IHI, despite the fact IHI does not hold an approved maintenance organization (AMO) certificate issued by the Minister pursuant to section 573.02 of the CARs, and only until such time that an agreement or technical arrangement between Canada and Japan that provides for the reciprocal recognition of each party’s maintenance certifications is in place.

PURPOSE

The purpose of this exemption is twofold.  First, it allows Canadian air operators operating BA3100 and BA3200 aeroplane types to group the two types for the purposes of providing Initial and Annual Recurrent Training and to complete Initial and Recurrent Pilot Proficiency Checks (PPCs).  Second, it allows Canadian air operators flight crew members to operate BA3100 and BA3200 aeroplane types without having to undergo Initial and Annual Recurrent Training and Initial and Recurrent PPC on both aeroplane types where the air operator has grouped the two types pursuant to subsection 704.108(2) of the CARs.

APPLICATION

  • This exemption applies to persons who perform maintenance on GE turbofan engine models CF34-8C, CF34-8E and CF34-10E, installed on Canadian registered aircraft;

  • This exemption applies to repairs conducted  by IHI to the specific fan blade part numbers that are listed herein only and, for which IHI is the sole source of repairs authorised by GE (OEM);

  • The specific fan blade part numbers covered by this exemption are as follows:

    1. part numbers 4114T15P02 and 4114T31G01 for the CF34-8C and CF34-8E turbofan engines models (4114T31G01 was introduced by Service Bulletin (SB) 72-0225 for CF34-8C and SB 72-0115 for CF34-8E.); and

    2. part number 2225M27P02 for the CF34-10E turbofan engine model

CONDITIONS

The exemption is subject to the following conditions:  

  1. Maintenance persons shall validate that the repair data used by IHI are specified in the most recent version of the applicable General Electric Instructions for Continued Airworthiness (ICAs); and more specifically:

    1. for CF34-8C model engines, the ICAs contained in:

      1. Engine Manual number GEK105091; and

      2. Service Bulletin SB 72-0225.

    2. for CF34-8E model engines, the ICAs contained in:

      1. Engine Manual number GEK112031; and

      2. Service Bulletin SB 72-0115.

    3. for CF34-10E model engines, the ICAs contained in:

      1. Engine Manual number GEK112081.

  2. Maintenance persons shall validate that the specific fan blade part numbers are listed and maintained on the capability list of IHI;

  3. Maintenance persons shall validate that the authorized release certificate used for the maintenance release of the repairs is issued in the form and manner authorized by the Japanese Civil Aviation Bureau (JCAB);

  4. Maintenance persons shall validate that the authorized release certificate is provided in English or French; and

  5. Maintenance persons shall validate that the repair data, its revision status and the work performed are identified on the authorized release certificate.

VALIDITY

This exemption is in effect until the earliest of the following:

  1. December 31, 2014 at 23:59 EST;

  2. the date on which an agreement or a technical arrangement between Canada and Japan is executed and, which provides for the reciprocal recognition of each party maintenance certifications;

  3. the date on which any condition set out in this exemption is breached; or

  4. the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to adversely affect aviation safety.
